Alabama Personal Injury Lawsuit
Statute of Limitations
Like all other states, Alabama has a law known as the "statute of limitations" which places a set time limit on personal injury lawsuits. Under Alabama Code Section 6-2-38, you have two years from the date of your accident to file a personal injury lawsuit against the responsible party. If you do not file a claim by this deadline, you will lose your right to pursue compensation.
This deadline is even shorter for injury claims against government entities. In Alabama, a formal claim against a municipality must be filed within six months while a claim against a county must be filed within one year. Our attorneys can help you understand the time limits which apply to your case and ensure your compliance with all legal deadlines.
Contributory Negligence in Alabama
It is important to know that Alabama is one of the few states which still follows the "contributory negligence" doctrine and requires defendants in law suits to be found 100% at fault in order to be held liable for any injuries caused to another party. To put it simply, under Alabama state law, if your case goes to trial and you are found by a jury to be even 1% at fault for your injuries, you will be completely prevented from any recovery.
Insurance companies are familiar with this law and may seek to use it during negotiations in order to persuade you to accept a lower settlement than you deserve. But to us, you are not just another claim-- our attorneys are driven to examine each case as it stands on its own-- and we will advocate on your behalf in a way that gives you the strongest voice possible in the process. At Spellen Law, facts matter-- and we take the time to know you and the facts-- to maximize your chance of recovery.
